At Parks & Braxton, PA, we represent clients in both county and circuit courts. County courts are where misdemeanor offenses are handled, while circuit courts handle felony offenses. The Florida Constitution actually distinguishes four different types of courts: circuit, Florida Supreme Court, Florida District Courts of Appeal and Florida County Courts. Fort Lauderdale, since it is located in Broward County, is represented by the Seventeenth Circuit Court.
Those facing misdemeanors could be facing charges in either the first or second degree. Second degree misdemeanors may be punishable by a maximum of 60 days in jail, maximum of six months’ probation and no more $500 in fines. A misdemeanor in the first degree has maximum punishments of a year in jail, a year of probation and a $1,000 fine. In Florida, there are five classes of felony offenses: third, second and first degree as well as life and capital felonies.
The lower the number, the greater the penalties (for degrees of charges). For example, third degree felonies are punishable by a maximum of five years in prison, while first degree felonies are punishable by a maximum 30 years in prison. Life felonies are punishable by life imprisonment without the possibility of parole, while capital felonies are punishable by death.
